TENDER NOTICE
Navodaya Vidyalaya Samiti is an Autonomous Organization of Ministry of Human Resource Development, Department of School Education & Literacy intends to hire vehicles, in particular DLY / DLZ Cars of branded name as mentioned in the Annexure-I & II on daily basis or on monthly basis, for official use.
A copy of the tender document for inviting sealed tenders for providing DLY / DLZ Cars for official use in NVS (Hqrs.) is enclosed.
In case some one is interested in providing the DLY / DLZ Cars to Navodaya Vidyalaya Samiti, he / she may drop the tender document, duly filled in, under seal cover at the above mentioned address in the tender box kept in the General Administration Section by 4.00 pm on or before 15th February 2008. Incomplete tender document will be summarily rejected. The tender document will be opened on 4.30 pm on 15th February 2008 in the presence of intended parties / their representatives, who may like to be present at that time.

Subject: Tender for contract of providing DLY / DLZ Cars to the Navodaya Vidyalaya Samiti (Hqrs.) – REG.
Sealed tenders are invited for award of contract for providing of DLY Cars for use by the Officers of the Navodaya Vidyalaya Samiti, A-28, Kailash Colony, New Delhi – 110 048 as per terms and conditions detailed out in the following paragraphs.
A. QUALIFYING CRITERIA:
Only registered and bonafied firms having experience in the tour and travel business and competence / capacity to provide requisite numbers of Cars at a short notice need only apply. It will be desirable that the bidder should have a minimum fleet strength of at least 5 Cars. While submitting the tender, the tenderers shall have to furnish to this Samiti (i) proof of experience (ii) financial turnover (iii) valid – ITCC, WTCC, STCC and Service Tax or any other tax applicable. A firm having any legal suit / criminal case pending against its proprietor or any of its Directors (in the case of Private Limited Company) or having been earlier convicted on grounds of moral turpitude or for violation of PF / ESI / Minimum of Wages Act or any other laws in force shall not be eligible.
B. SCOPE OF WORKS:
(a) Rates may be quoted for providing DLY / DLZ Cars to the Samiti for official use.
(b) The agency must have a 24 hours working telephone system so that the agency can be telephonically contacted at short notice and at odd hours and on holidays in case of requirement of Cars. It would be essential for the Driver to have mobile phone so that they could be contacted for duty.
In the matter of any disputes, between the parties regarding the terms and conditions of the contract and execution thereof, the matter shall be referred to an Arbitrator(s) as may be appointed by the Commissioner, Navodaya Vidyalaya Samiti for arbitration under the Arbitration & Conciliation Act, 1996. The Contractor shall not question the decision of the arbitrator(s) on the ground that the Arbitrator(s) is / are Government servant(s). The decision of the Arbitrator(s) shall be final and binding on both the parties.
1. Cars, which are in excellent running conditions with immaculate, seat covers and bearing numbers DLY / DLZ only will be hired. The proof that the cars are registered in the name of the firm would have to be submitted to the Samiti.
2. As far as possible, the same cars will be deployed and the drivers would not be changed without prior notice. In case the car / driver is changed without prior notice and the substitute vehicle / driver is not found suitable, 70% of the charges for the days the new driver / car is deployed would be deducted on each occasion.
3. The firm will have to provide Registration Number(s) of vehicles and models as per requirements of the Samiti.
4. The vehicle would be insured in all respects by the firm. In case of any accident or theft etc. all the claims arising out of it will be met by the firm and this Samiti shall not be liable in any matter whatsoever.
5. The DLY / DLZ Cars should not be more than two years old in respect of Diesel and petrol models. The proof of their purchase / registration will have to be submitted to the Samiti.
6. The Driver of DLY / DLZ Car should be well conversant with the routes of Delhi / Noida / Gurgaon. They should wear uniform and should be well behaved.
7. The antecedents of drivers to be deployed should be properly verified and their details will have to be provided to this Office. In case of change of driver, prior permission will be required to be taken.
8. The owner should be in a position to provide standby cars within an hour of reporting any break down to the contractor telephonically. All expenses are to be borne by the firm in case of breakdown of a vehicle(s) supplied. The taxi charges from the point of breakdown are to be borne by the firm to complete the trip.
9. For out-station duty, the vehicle may have to be provided by the firm at a short notice.
10. DLY / DLZ Car should comply with all pollution control regulations and norms.
11. Payment of hiring charges will be made on monthly basis. The bills for the use of vehicles accompanied by the duty slip / logbooks will be preferred by the firm after each completed month.
12. No dead mileage would be payable from the contractors premises to the Samiti and vice-versa. A logbook for each car in the format prescribed by the Samiti, for each of the journeys performed, duly signed by the Officer, would be maintained and submitted by the Contractor along with the bills and duty slips.
13. Actual parking charges, toll taxes / inter-state taxes for journeys will be reimbursed along with the hiring charges bills.
14. No request for escalation in rates would be entertained for whatsoever reasons, during the currency of the contract. However, in the event of appreciable revision in the prices of petroleum products by Government of India / Government of Delhi, appropriate revision in the quoted rates could be considered.
15. In the event of Contractor backing out of the contract midstream, without any explicit consent of the Samiti, the firm / contractor will be liable to the recovery of the higher rates, vis-à-vis those contracted, which may have to be incorporated by the Samiti on the transportation of Officers for the balance period of contract through alternative means. The bill amount of the month would also be forfeited.
16. In case the firm fails to provide vehicles as contracted on a particular day, the vehicles will be hired by the Samiti from any other source and the difference between the rates of the firms accepted by the Samiti and the rates on which the vehicle is hired will be recovered / adjusted form the bills of the firm due for payment by the Samiti.
17. In case of default on the part of firm to provide requisite number of Cars for more than five occasions during the contract period, the contract will be terminated and awarded to another firm at the risk and cost of the defaulting firm.
18. In case the vehicle provided to the Samiti breaks down during the period of hire, the firm will immediately replace it with another vehicle of equally good condition.
19. In case DLY / DLZ cars do not report in time, a penalty of Rs. 300/- per day per car will be levied on the agency, which will be deducted from the subsequent bill. The decision of the competent authority in the Samiti shall be final and binding on the contractor / firm and which shall not be open to arbitration.
20. The firm will also be required to submit an undertaking that no legal suit / criminal case is pending against its proprietor or any of its Directors (in the case of Private Limited Company) for any violation in PF Act / ESI Act / Labour Laws etc. or having been earlier convicted on ground of moral turpitude or for violation of any other law and will provide details in case there is any such suit / criminal case pending.
21. All requirements under various statutory laws including Contract Labour Act, Income Tax and Service Tax etc. must be complied with. Any default will be liability of the firm and the firm shall be liable to reimburse any amount paid by the Samiti by way of such a default, interest and penalties. The firm shall undertake to furnish all the details as and when asked for by the Samiti in this regard.
22. The firm applying for this tender should provide certificates from the concerned authorities about the payment of Service Tax, Income Tax, PF registration and any other tax applicable for the previous year.
23. TDS and other taxes as applicable will be deducted from each bill.
24. Failure by the contract / firm to comply with any statutory requirements and terms of the agreement during the period of contract shall result in termination of the contract and subsequent disqualification for participation in any future tender in the Samiti. The security deposit will also be forfeited.
25. The Samiti has all the right to reject / accept any / all the tenders without assigning any reason.
26. Tender application without complete documents / information shall not be considered.
27. No negotiation will be undertaken with any tenderer except lowest qualified bidder.
E. TENDERING PROCESS
The tender is invited on a twin bid basis i.e. qualifying bid and then the financial bid. The tender form for qualifying bids and financial bid prescribed at Annexure-I and II (attached) complete in all respect should be submitted in separate sealed covers superscribed `Qualifying Bid – Contract for supply of DLY / DLZ Cars for Navodaya Vidyalaya Samiti’ and Financial Bid – Contract for supply of DLY / DLZ Cars for Navodaya Vidyalaya Samiti’ and put together in one envelop addressed to the Assistant Commissioner (General Administration), Navodaya Vidyalaya Samiti, A-28, Kailash Colony, New Delhi – 110048 and should be dropped in the tender box kept in the General Administration Section by 4.00 PM on or before 15th February 2008. Incomplete bid document will be rejected. The bids will be scrutinized by the Samiti to shortlist the eligible bidders. The financial bids of the eligible bidders only will be opened. Negotiations, if any, will be held with only the lowest qualified bidder.
Late submission of tenders will not be accepted. The Samiti reserve the right to reject any or all quotations without assigning any reason.
NOTE:
The tenderer should sign and stamp each page of this tender document as a token of having read and understood the terms & conditions contained herein and submit the same along with the bid. No photocopies of this tender document would be accepted. The tenderer would fill up the information in the Annexure-I & II enclosed at the end of this document in clear and legible terms. Wherever, the prices are to be quoted these should be written in figures and words as well. The quoted prices should also include the impact of all over-heads. Annexures will also have to be signed and stamped by the firm through its authorized signatory.
